Momentum for federal data breach notification legislation inched forward on Tuesday during a House Energy & Commerce subcommittee hearing on Capitol Hill. Witnesses representing the tech and retail industries; Acxiom, as well as a law professor, testified about what would make an appropriate bill. Though lawmakers on both sides of the political aisle backed a bipartisan effort to pass a federal standard, there still is not agreement on what level of preemption a federal law would have on existing state laws, whether there should be a harm-based trigger and who should be responsible for notification.
