When lawsuits or other inquiries come in that require e-discovery, it’s smart to simply not have the documents there to produce in order to avoid legal exposure. The IT department should work with the legal department to create a “data destruction plan.” Included in that plan might be the elimination of shared folders; only retaining personal information on employees required under labor laws, and perhaps deciding to have all emails “gone after a year.”
