Recently introduced legislative changes have given the Information Commissioner's Office (ICO) the right to audit National Health Service (NHS) authorities for compliance with the UK Data Protection Act.

As of February 1, the ICO has been able to subject public healthcare organisations to compulsory audits, which had previously only applied to central government departments. The audit powers will allow the ICO to review how the NHS bodies handle patients' personal information and also review areas including data security, records management, staff training and data-sharing.

The audit powers mean the ICO will be able to assess data protection practices by England's NHS foundation trusts, GP surgeries, NHS Trusts and Community Healthcare Councils and their equivalent bodies in Scotland, Wales and Northern Ireland under section 41A of the Data Protection Act. The new legislation will not apply to any private companies providing services within public healthcare.
